PRETORIA, South Africa — OAK Law has published a guide for property developers and investors examining a structural decision that shapes every transaction in a portfolio but rarely receives the attention it deserves: the marital property regime the investor is married under. The article addresses a reality that many active property professionals only discover when a deal stalls or a lender raises questions they were not expecting.

South African law defaults to marriage in community of property when no ante-nuptial contract is in place. For a salaried professional, the practical effects are manageable. For someone running an active development pipeline or building a commercial property portfolio, the consequences compound across every transaction. The joint estate framework means that selling, mortgaging, or otherwise dealing with property generally requires the other spouse’s written consent before the transaction can proceed. When deals move quickly and financing windows are tight, that recurring administrative step becomes a commercial friction point that can determine whether an opportunity is secured or lost.

The guide walks through how community of property creates joint exposure to development and project debt, why lenders assess the combined joint estate rather than the investor’s individual position, the complications that arise in partnership and joint venture structures when one party cannot contract independently, and how an ANC, structured either with or without accrual, removes these constraints while still allowing flexibility in how the broader estate is treated.

One detail the article highlights that many investors overlook: an ANC must be signed before the marriage and registered at the Deeds Office within three months. Missing that registration window means the agreement is not enforceable against third parties such as creditors or lenders until the position is corrected. Marrying without an ANC at all triggers a far more complex path through the High Court.
